Terms and conditions here below described relate to the service provided by 7Pixel S.r.l. (here in after 7Pixel) and consisting of a space available in internet, where registered users can express their personal remarks relating to the goods (or services) offered for the sale by third parties and found through the web-sites included into Trovaprezzi Network.
2) Registration
In order to have access to this service users must register; they must provide for a valid e-mail address, a username and a password. The username and the password must be considered as confidential information and they do not have to be communicated to anyone. In order to complete the registration, after filling in the specific form, the users will receive a message sent from the e-mail address info@shoppydoo.com at their e-mail address. Accordingly, users must click on the link they will find in the e-mail received. Only in this way, the service can be activated in order to assure that the e-mail address provided belongs to the person who filled in the form. The registration requires the acceptance of the general terms of the service that are here below described.
3) Contents
With this service the registered users have the possibility to express their personal remarks with respect to the goods and the services offered or purchased from sellers reached through the web-sites included into Trovaprezzi Network. To express their opinion, the registered users are obliged:
- not to break any copyright, trade-mark, patent right or other privileges or similar right;
- not to spread indecent, pornographic, blasphemous or offensive material;
- not to commit any crime against morality or public order, abuse, slander, incitement to commit a crime or to racial discrimination;
- not to break Italian law relating to the Privacy.
In any case the registered users will keep 7Pixel undamaged with respect to any claims received and related to the breach of one of these rights or the law. The registered users must abstain to use directly or indirectly the service for advertising related to the trade-marks or to the goods or services offered. The breach of one of these conditions by a registered user will determine the automatic cancellation of the contract with the immediate stop of the service provided and the right for 7Pixel to the compensation of any additional damage.
4) Protection of Privacy according to Italian law (D.Lgs. n. 196/2003)
According to article 13 of the Legislative Decree n. 196 dated June 30, 2003 " Codice in materia di protezione dei dati personali" (Code related to the protection of personal data), 7Pixel, the owner ("Titolare") of the treatment has to provide for information related to the use of personal data relating to the registered users.
The collection of personal data is performed registering data provided by the user (as interested party) at the moment of registration, as previously described.
Personal data collected by 7Pixel are used exclusively for the supply of the service previously described.
The treatment of data will be performed through instruments suitable to guarantee their security and their Privacy and can be performed also through automatic instruments suitable for the storage, the management and the transmission of these data. The treatment will be in any case performed with procedures responding to the requirements provided for the Legislative Decree n. 196/2003 and the Attachment "B" of the Legislative Decree.
The assignment of the data is compulsory: the absence of these data will not allow the start, the management and the continuation of the contract, because 7Pixel could not be able to provide for its services and for the registered users to control the regular attainment of the contract.
Owner of the treatment ("Titolare") is the company 7Pixel, with registered office in Via Copernico n. 2, Binasco (Milano).
The registered users have the rights mentioned in the article 7 of the Legislative Decree n. 196/2003 and, consequently, they can have access to their data, ask for the correction or the completion and eventually for the cancellation; in addition, they can ask for the stop of the service as provided by articles 8, 9 and 10 of the above mentioned Legislative Decree, according to the specific procedures described.
5) Privacy
The registered user is considered the sole responsible for any use carried out under his name, his login or his password. Accordingly, he will be considered responsible for any damage caused to 7Pixel as a consequence of an unauthorized use. In any case of appropriation by anyone of a registered user's login or password, the registered user is obliged to communicate it to 7Pixel immediately.
6) Limitation of liability
7Pixel does not exercise any kind of control on what included in comments made by registered users; as a consequence, 7Pixel will not have any responsibility on the completeness, reliability, correctness and on the content of the comments included in the web-site. The registered user accepts to use these comments exclusively at his own risk, renouncing to claim back 7Pixel for damages. 7Pixel is not responsible in any case of any technical failure that will affect the service.
7) Duration of the contract
This contract is an open-ended contract. 7Pixel has the right to interrupt in any time the supply of the service. 7Pixel and the registered users can recede from the contract in any moment, without notice, also with an e-mail.
8) Change in the general terms
On the base of his personal judgement, 7Pixel can modify in any time, partially or entirely, the terms and conditions here described; this, after appropriate disclosures for the users that will be included in the web-site. The use by a registered user of the service provided by 7Pixel will be considered as an acceptance of any term included in this contract or of any subsequent change.
9) Applicable law and Court of competent jurisdiction
The Italian law is applicable for this contract., the competent law Court is the Court of Milan (Italy) for any litigation which could arise from this contract.
